A Message from Dr. Estrella Regarding Recent Immigration Enforcement in Norwalk

Dear NPS Community,

In light of recent events involving federal immigration enforcement activity in Norwalk, we want to take this opportunity to reaffirm our commitment to the safety, dignity, and well-being of every student, family, and staff member in Norwalk Public Schools, regardless of immigration status.

On Friday, August 15, Mayor Harry Rilling held a joint press conference alongside Norwalk Police Chief James Walsh, members of the Common Council, and the Norwalk Board of Education to provide an update following recent activity by U.S. Immigration and Customs Enforcement (ICE) in the city.

Mayor Rilling confirmed that on Thursday, August 14, ICE agents entered the parking lot of the Norwalk Police Department without prior notice, authority, or consent from the City or the Police Department. The Department promptly instructed the agents to leave. A similar incident occurred again on Friday, August 15, and ICE agents were once again directed to leave by the Norwalk Police Department. The mayor emphasized that these actions were taken without communication or coordination with local authorities. He also strongly criticized the tactics used, such as wearing plain clothes and face coverings and driving unmarked vehicles, noting that these practices are inconsistent with the values of the City of Norwalk.

We understand that these events, along with recent federal changes removing schools, hospitals, and places of worship from the list of “sensitive locations,” may create feelings of fear or uncertainty among members of our school community. Please know that Norwalk Public Schools remain steadfast in our mission to ensure that every student feels safe, welcomed, and supported in our schools.

With the new school year beginning Monday, August 25, we want to reiterate the safeguards and guidelines we have in place. District staff are trained in how to respond to any inquiries or actions by non-local law enforcement, including ICE, and we remain in close coordination with the City of Norwalk and the Norwalk Police Department to uphold the rights and safety of our school community.

District Guidelines Regarding Non-Local Law Enforcement and ICE Actions

To safeguard our students and school environments, our district follows strict protocols:

  1. No Consent to Access: Our district does not consent to non-local law enforcement, including ICE, entering school facilities, accessing students, or reviewing student records without legal authority. School principals and staff are not authorized to grant such access without prior consultation with our Legal Counsel.
  2. Judicial Warrants Required: Only judicial warrants signed by a judge are recognized as valid. Administrative warrants are not sufficient to permit ICE to enter our schools. Any documentation presented by non-local law enforcement will be reviewed by Legal Counsel to determine its validity before any action is taken.
  3. Immediate Legal Review: If non-local law enforcement, including ICE, arrives at a school, they will remain outside the premises while the school security officer collects identifying information and consults with the school building leader. The building leader will then consult with Legal Counsel to determine the appropriate course of action. Access will not be granted without explicit authorization from Legal Counsel.

Protecting Student Records

Federal laws such as the Family Educational Rights and Privacy Act (FERPA) safeguard student records. These records cannot be shared with law enforcement without a valid court order, subpoena, or the informed written consent of a parent or guardian (or the student, if 18 or older).

What This Means for Families

We recognize the potential stress and concern these guideline changes can create. To support our families:

  • Clear Communication: If an immigration enforcement action is attempted, families will be notified promptly after consultation with Legal Counsel.
  • Access to Resources: We are partnering with local organizations to offer legal assistance, workshops, and counseling to help families navigate these challenging times.
  • Emergency Planning Support: Our Family Center team is available to work directly with families to create personalized emergency plans. These plans are designed to provide peace of mind and ensure that families are prepared in the unlikely event of an enforcement action.

We are grateful for the leadership of Mayor Rilling, Chief Walsh, and our Board of Education, and for their shared commitment to standing in solidarity with all members of our community.
